TOWN OF WILTON PLANNING BOARD MEETING DRAFT MINUTES DATE: December 17, 2008 TIME: PLACE: PRESENT: Wilton Planning Board Members: Chairman Jeff Kandt, Alec MacMartin, Neil Faiman, Brian Sullivan, Alternate Walter Zuber, Board of Selectman Representative Bill Condra, Clerk Heather Loewy Nichols. Adjournment Chairman Jeff Kandt called the meeting to order at 7:35 p.m. Walter Zuber joined the Board as a voting member, in place of Michael Cooley, at 7:36 p.m. 1. Minutes: - December 3, 2008 A MOTION was made by Mr. MacMartin and SECONDED by Mr. Faiman to approve the minutes of December 3, 2008 as amended. Voting: 5 ayes; motion carried with Mr. Sullivan abstaining. Continuations: 2. PB-07-001-CSD: Cluster Subdivision – First Light Farm, LLC – Lots F-095-02,03,07,13,14 and 15 on Isaac Frye Highway in the Residential/Agricultural district. Applicant is proposing 22-unit cluster subdivision. Ray Shea appeared before the Board for the applicant and stated that the applicant has received an Alternation of Terrain permit and the State Subdivision permit is ready to be released pending water system approval. He noted that the wells have been drilled and they are currently waiting for the water testing to be completed. He further explained that he submitted a plan to LaBombard Engineering for review after discussion regarding the water run off issue. Mr. Shea stated that Mr. LaBombard, in his most recent review states that the applicant has done as much as they can to address the water run off issues. Mr. Shea further explained that per Mr. LaBombard the applicant will revise the format of the bond estimate and resubmit it to LaBombard engineering. He also noted that Mr. LaBombard has asked for a profile of the roads and explained that the roads will be left at grade and different gravel will be used at the 10-12% grade areas as requested by the Board. Mr. Shea stated that in previous discussions the applicant understood that the Board was satisfied with the information currently provided on the plan regarding the road profiles. Mr. MacMartin asked that a note be placed on the plan that states that the grading will not exceed a certain amount. After discussion, Mr. Shea agreed to show the finished contours of the road on the plan. Mr. Shea stated that Mr. LaBombard is concerned about the oversight of the installation of the roof runoff downspouts. In response to a question from Mr. MacMartin, Mr. Shea stated that he will do some research to determine whether something will be installed to stop debris from entering into the roof runoff systems. Mr. MacMartin suggested that a note be added to the plan that states that if there are any questions as to the roof runoff system installation then the inspector should refer to the designing engineer at the cost of the building permit applicant. The Board and Mr. Shea discussed Mr. LaBombard’s concern that the well road be bonded. Mr. MacMartin suggested that a note on the plan could be added that states that the road to the well is to be completed before the first building permit is granted and noted that he is not concerned about the road to the barn as the Board has determined that the road to the barn is not necessary. A MOTION was made by Mr. MacMartin and SECONDED by Mr. Faiman to continue the application to January 21, 2009. Voting: 6 ayes; motion carried unanimously. 3. PB-07-014-SD: Cluster Subdivision - Perham Woods – Lots B-020 on Dale Street in the Residential & Agricultural, Wetlands and Flood Plain District. Applicant is proposing a 29 unit cluster subdivision. Dawn Tuomala, from Monadnock Survey, appeared before the Board for the applicant and explained that all the necessary documents have been submitted, Town Counsel has replied, and the applicant’s attorney is making the necessary revisions to the documents. She also explained that the permits are in process and all the applications have been accepted as complete but the holidays have slowed down the approval process. A MOTION was made by Mr. MacMartin and SECONDED by Mr. Sullivan to continue the application to January 21, 2009. Voting: 6 ayes; motion carried unanimously. 4. PB-08-003-SD: Subdivision Application – Gary & Betty Raymond - Lot E10-2, 789 Gibbons Highway – Applicant is proposing converting an existing duplex into a condex. A MOTION was made by Mr. MacMartin and SECONDED by Mr. Faiman to continue the application to January 21, 2009. Voting: 6 ayes; motion carried unanimously. 5. PB-08-008-SD: Subdivision – Donald Slowik – Applicant is proposing to subdivide Lot B 31-3, located on Pead Hill Rod, into three single family lots. The Clerk gave the Board an update of her correspondence with the applicant since the last meeting. A MOTION was made by Mr. MacMartin and SECONDED by Mr. Faiman to continue the application to January 21, 2009. Voting: 6 ayes; motion carried unanimously. 6. PB08-022-SB: Subdivision – Parker – Lots B 35-1 on Pead Hill Road – The applicant is proposing creating two new lots from the existing 23 acre lot. Dawn Tuomala, of Monadnock Survey, appeared before the Board for the applicant and stated that Town Counsel has reviewed and approved the revised documents but the applicant is still awaiting signatures as the signees have been out of town. Ms. Tuomala submitted the mortgage subordination documents and explained that the note on the plans which referred to the easement has been changed. Mr. MacMartin explained that the Board usually has a letter from the applicant’s attorney that states what liens encumber the lots.
A MOTION was made by Mr. MacMartin and SECONDED by Mr. Faiman to approve the application conditional on the receipt of the declaration with original signatures, the original partial mortgage release, the mortgage subordination from Elizabeth Drolet and the appropriate fees. Voting: 6 ayes; motion carried unanimously. Mr. MacMartin left the meeting at 8:38 p.m. 7. PB08-019-SD: Subdivision – Carlo & Anne Simoni - A Subdivision Application by Carlo and Anne Simoni to divide Tax Map H Lot 56, on Badger Farm Road and Issac Frye Highway, into 6 lots. Ray Shea, from Sanford Survey, appeared before the Board for the applicant and explained that the applicant has submitted a variance application to access three regular lots and one reduced frontage lot from a private way and for the wetland crossing. He also stated that he has met with the Conservation Commission and they are okay with the wetland crossing and the current set up of the plan. He further explained that after the applicant receives Zoning Board approval they will be submitting a Dredge and Fill application. He also noted that he has tried to contact the Fire Chief and A MOTION was made by Mr. Sullivan and SECONDED by Mr. Zuber to continue the application to January 21, 2009. Voting: 5 ayes; motion carried unanimously. 8. Other Business - Zoning Changes Review Mr. Condra raised concerns about the current application fee language and Mr. Kandt stated that the Board will address the fees and other regulation changes in the February work session. Mr. Condra suggested that the Board should enact a regulation to require underground utilities in all new subdivisions. 9. Adjournment A MOTION was made by Mr. Sullivan and SECONDED by Mr. Condra to adjourn. Voting: 5 ayes; motion carried unanimously.
